Once Poker System Terms & Conditions

This agreement ("Agreement") must be read in its entirety, together with the ONCE POKER Privacy Policy, Tournament Poker Rules, and Cash Game Poker Rules, before participating in any live poker tournaments or cash games ("Tournament") organized as part of ONCE POKER events, such as the ONCE POKER Championship or ONCE POKER Regional Tours (each an "Event"). Participation in an Event requires registration and acceptance into the ONCE POKER System (defined below).
By entering this Agreement, you acknowledge that "ONCE POKER" is a brand operated by ONCE Gaming Limited ("ONCE Gaming," "we," "us," or "our"). Depending on the Event location, you will contract with ONCE Gaming or its affiliates. You may also need to agree to separate terms and conditions of the casino venue hosting the Event ("Casino Venue Terms and Conditions"), which will be provided by the venue.
This Agreement is a legally binding contract between you and ONCE Gaming, constitutes the entire understanding regarding your participation in ONCE POKER Events and use of the ONCE POKER System, and supersedes any prior agreements with ONCE Gaming.

REGISTRATION - ONCE POKER SYSTEM

1. Registration Requirement: To participate in an Event, you must register your details with us. Registration may occur:

   • In person at the Event venue.

   • Via the ONCE POKER online registration system ("ONCE POKER System") where available.

2. ONCE POKER Card: At Events using the ONCE POKER System, you will receive a registration card ("ONCE POKER Card") upon first registration. Participation after registration, even without signing the form, constitutes acceptance of this Agreement.

3. ONCE POKER Account: You must provide accurate and up-to-date personal information to create an account on the ONCE POKER System ("ONCE POKER Account"). See our Privacy Policy for details on data usage.

4. Event Registration Process:

   • You need your ONCE POKER Card to register for an Event, unless registering for the first time.

   • Your Event entry ticket will be reserved until the Event starts or you collect it.

   • For Tournament prize winnings, present your ONCE POKER Card to have the prize allocated and collect it at the venue, along with a receipt detailing the Tournament, your ranking, and prize money.

   • You may cancel a Tournament reservation before it begins by:

     • Emailing support@oncepoker.com at least 48 hours prior with the subject "Tournament Reservation Cancellation – Urgent," including the Tournament number and a cancellation request, sent from your registered email.

     • In person at the Event venue’s registration desk.

   • Once a Tournament begins, cancellations are not permitted, and buy-in amounts are non-refunded if you fail to participate.

5. Single Account Policy: You are permitted only one ONCE POKER Account.

6. Identity Verification: We may conduct identity checks, including through third-party services, using your provided information ("Identity Checks").

7. Right to Refuse: We may refuse entry to Events, disable your ONCE POKER Account, or cancel your ONCE POKER Card at our discretion, including after Identity Checks.

8. ONCE POKER Assets: The ONCE POKER Card remains our property. We may restrict, suspend, or terminate its use, your access to the ONCE POKER Account, or the ONCE POKER System if we believe you have:

   • Abused or attempted to abuse the ONCE POKER Card, Account, or System.

   • Breached any terms of this Agreement or Tournament rules.

   • Engaged in abusive, offensive, or misleading behavior.

   • Failed Identity Checks.

LIMITATION OF LIABILITY

1. Non-Transferable Card: The ONCE POKER Card is non-transferable, cannot be copied, and may only be used by you for permitted purposes.

2. No Warranties: The ONCE POKER System and Card are provided "AS IS" without warranties regarding quality, fitness, or accuracy. We may modify or discontinue them without notice.

3. Safekeeping Responsibility: You are responsible for safeguarding your ONCE POKER Card and related passwords. We are not liable for losses due to your failure to do so.

USE OF LOGOS AND SPONSORSHIP

1. Sponsorship Restrictions: You may not be sponsored by or wear logos of an Unauthorised Operator (e.g., unauthorized poker, betting, or gaming operators). We may require logo removal or disqualify you for non-compliance.

2. Prohibited Logos: No player may wear logos that are illegal, indecent, offensive, or discriminatory under local laws or our discretion.

3. Logo Limits: Except at TV Tables, players may wear approved gaming operator logos (max 70 sq cm on breast pocket or upper sleeve).

4. Local Regulations: Players must comply with local laws and Casino Venue Terms and Conditions regarding logos.

5. Approved Logos: Additional logos from ONCE POKER or its affiliates are permitted with approval.

6. Sponsored Players: Players sponsored by reputable gaming sites must obtain our written approval before wearing sponsor logos from the Event’s start.

IMAGE RIGHTS AND TV/WEBCAST TABLES

1. Media Rights: We may photograph, record, or broadcast any Event, including your participation, for worldwide use in all media. You grant us rights to use your likeness, voice, and image ("Contribution") royalty-free in perpetuity.

2. TV Table Restrictions:

   • No more than two players per TV Table may wear the same company’s logo (except ONCE POKER).

   • Logos on TV Tables are limited to 7cm x 4cm on breast pocket or sleeve; visible logos on caps or card protectors are prohibited.

   • We may remove non-compliant logos or apparel.

3. TV Table Rules:

   • You may need to surrender electronic devices before playing at a TV Table.

   • No smoking or e-cigarettes are allowed.

   • Communication with non-players is prohibited during play, except for technical issues or when not active in a hand.

   • Players must remain in designated areas during breaks and show hole cards to cameras unless playing blind.

4. Conduct: Profanity, violent behavior, or misconduct at TV Tables may result in penalties or disqualification.

INTELLECTUAL PROPERTY

1. Ownership: ONCE Gaming owns all Intellectual Property Rights in ONCE POKER Assets, including trademarks like "ONCE POKER" and domain names.

2. Contribution Rights: You grant us perpetual, royalty-free rights to use your Contribution in all media. You waive moral rights and claims related to privacy or copyright infringement arising from such use.

DATA PROTECTION

1. Data Processing: We process your personal data to organize Events, based on contractual necessity. Images may be used for promotion with your consent. See our Privacy Policy for details.

MISCELLANEOUS

1. No Warranty/Assignment: No assurances outside this Agreement apply. We may assign our rights without notice.

2. Enforcement: We may take action to enforce this Agreement.

3. Indemnity: You indemnify us against costs from your breach of this Agreement.

4. Rule Changes: We may amend Tournament or Event rules, with changes posted on our site or notified to you.

5. Settlements: Final table settlement discussions must occur at the table with a Tournament representative present.

6. Cancellation Rights: We and the venue may cancel or alter Events at our discretion.

7. Eligibility: ONCE Gaming employees and their immediate family are ineligible to play unless approved.

8. Disqualification: We may disqualify players for rule violations, intoxication, or inappropriate behavior, forfeiting buy-ins and prizes.

9. Taxes: You are responsible for all taxes on prizes and must submit accurate tax returns.

10. Governing Law: This Agreement is governed by the laws of the Isle of Man, with disputes resolved in its courts.

11. Language: For Events in jurisdictions requiring English-only rules (e.g., New Jersey), violations may lead to penalties or disqualification.
